RE: The tariff classification of a Non-Adhesive Label from Canada

Dear Mr. Thompson:

In your letter dated November 7, 2002 you requested a tariff classification ruling.

You submitted a sample of a non-adhesive label, made of lexan material – a polycarbonate that is sold to various companies who manufacture machinery or equipment. This item, you state, could be mounted on a dash of a snowmobile or on a dash of a motor vehicle. The non-adhesive label would be mounted over a panel that can be illuminated. For example when starting a car, if the seat belt is not fastened, you will see a light on your dash, with a person wearing a seat belt.

The applicable subheading for the Non-Adhesive Label will be 8512.90.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for Electrical lighting or signaling equipment (excluding articles of heading 8539), windshield wipers, defrosters and demisters, of a kind used for cycles or motor vehicles: parts thereof: Parts: Of signaling equipment. The rate of duty will be 2.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
